Terms of Service

1. Definitions

  • Service — the ConsentKit platform, including the web dashboard at consentkit.pl and the embeddable consent widget script.
  • Provider — SoftWhale Maciej Grabowski, the entity operating the Service.
  • User — any natural or legal person who registers an account and uses the Service.
  • Account — a registered user profile created on consentkit.pl.
  • Site — a website or web application added by the User to their ConsentKit account.
  • Widget— the JavaScript snippet generated by ConsentKit and embedded on a User's Site to display a cookie consent banner.
  • Free Tier — the no-cost plan available to all registered Users, subject to usage limits.

2. General Provisions

These Terms of Service ("Terms") govern access to and use of the Service provided by SoftWhale Maciej Grabowski (Poland, NIP: 7631993505). By creating an Account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

3. Account Registration

  • You must provide a valid email address to register.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • Each person may hold only one Account.
  • You must be at least 18 years old or have the legal capacity to enter into a contract in your jurisdiction.
  • You agree to provide accurate and up-to-date information and to update it as necessary.

4. Service Scope

ConsentKit provides:

  • A web dashboard for managing Sites and customising the consent Widget.
  • An embeddable JavaScript Widget that displays a cookie consent banner on your Site.
  • Basic analytics on consent interactions (aggregate only).

Important:The Widget processes consent decisions entirely on the end user's device. ConsentKit does not store individual consent records on its servers. You are responsible for implementing appropriate consent storage on your own infrastructure if required by applicable law.

5. Free Tier & Billing

The Service is currently available free of charge on the Free Tier. Paid plans may be introduced in the future. If paid plans are launched, existing Free Tier Users will be notified at least 30 days in advance, and their current usage will not be disrupted during that notice period.

6. User Obligations

You agree to:

  • Use the Service only for lawful purposes.
  • Comply with all applicable laws, including GDPR, CCPA, and any other privacy regulations applicable to your Sites.
  • Not attempt to reverse-engineer, scrape, or abuse the Service infrastructure.
  • Not share your Account credentials with third parties or create Accounts on behalf of others without authorisation.
  • Take sole responsibility for the Sites you add and the consent configurations you deploy.

7. Liability Limitations

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. In particular:

  • The Provider does not guarantee uninterrupted or error-free operation of the Service. No uptime SLA is provided on the Free Tier.
  • The Provider is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
  • Using ConsentKit does not constitute legal advice and does not guarantee compliance with any specific regulation. You are responsible for assessing your own legal obligations.

8. Service Changes

The Provider reserves the right to modify the Service or these Terms at any time. For material changes, registered Users will be notified by email at least 30 days before the change takes effect. Continued use of the Service after a change constitutes acceptance of the updated Terms.

9. Termination

You may delete your Account at any time from the dashboard. Upon deletion, your Account data will be permanently removed within 30 days. The Provider may suspend or terminate an Account that violates these Terms, with or without prior notice depending on the severity of the violation.

10. Contact & Governing Law
